Regarding construction, almost all Danish construction contracts, both small private construction agreements and major construction contracts, irrespective of the nationality of the contractor, are based on agreed documents. Especially the “AB 92” is very common.


How are construction contracts regulated in Denmark?

Except for procedures based on the Public Procurement Directive and the Danish Procurement Act, no specific Danish legislation exists on the subject of Danish construction contracts. Instead these are based on agreed documents, most common is the “AB 92”, which applies to both small private construction agreements and major construction contracts, irrespective of the nationality of the contractor.  



What should you be aware of when applying the "AB 92"?

The “AB 92” is a set of contract provisions decided on in 1992 by the Danish construction industry. However, as with all standard agreements, it is always important to ensure that all aspects not regulated by the provisions are covered by the individual contract such as contents of the individual assignment.


Contracts entered into by the developer and the developer’s technical adviser are typically based on the provisions of the “ABR 89”, which, as well as "AB 92", is a set of contract provisions having been resolved by the Danish construction industry.
